Canadian political lawsuit for repatriation of asylum seekers due to pandemic

Canadian authorities’ policy of returning asylum seekers back to the US “is illegal and violates their rights”, according to a lawsuit filed in federal court on Tuesday by the Refugee Bar Association, which claims that this policy does not address the situation of applicants nor if they have other alternatives available.

The policy also denies asylum seekers the right to be heard, according to a copy of the lawsuit filed by Reuters.

Between March 21, 2020 and April 20, 2021, Canada repatriated 387 asylum seekers trying to cross ports of entry, according to the Canadian Border Services. Although Canada has said it could return later, the lawsuit alleges that the country’s authorities do not in any way guarantee that the removal of the refugees is indeed a temporary solution.
