Shooter goes to jury on September 21 for breaking into funeral home after employee and ex-wife
Defendant for trying to kill his ex-wife’s boyfriend and hurting a funeral home client “by mistake”, Wellington Barbosa de Almeida, 28, returned to jail after “disappearing” during the pandemic. He had won the right to respond to the free trial in February 2019, but in March of last year, he failed to appear in court every month and was arrested again.
Wellington Barbosa has been arrested again since July 30th. Through lawyers, he has tried to return to freedom, but all requests have been denied. The last “no” came from the 3rd Criminal Chamber, on the 9th of this month, as published in the Official Gazette of Justice. ,
In the understanding of most of the judges of the class, the defendant “failed to comply with the precautionary measures imposed at the time of granting his provisional freedom in an unjustified manner”, although his defense argued that the client was informed, in March of last year, that the activities of the Forum were suspended because of the pandemic, he informed the former lawyer and the latter did not justify the absence of Wellington in the process.
It turns out that after the finding that the accused of double attempted murder had not shown up for more than a year, he was summoned to present a justification, on June 24, but he did not do so.
By denying the first request for the revocation of preventive detention, Judge Carlos Alberto Garcete, of the 1st Court of the Jury, recalled that “the judgment session of the defendant was set for September 21, 2021, at which time his provisional detention will be again evaluated”.
The crime – Wellington Barbosa de Almeida, then 24, invaded Pax Real do Brasil, located on Avenida Bandeirantes, in Campo Grande, and shot his ex-wife’s current boyfriend, in addition to injuring a customer at the funeral home. It all happened early in the morning of December 1, 2017, a Friday.
According to witnesses, Douglas Nogueira and his girlfriend, Valéria da Silva Fernandes, arrived to work at Pax when they were surprised by the man. The two ran to reception and the author followed with a shot and hit Douglas. Then he fled on a motorcycle.
Douglas was shot in the abdomen. The other victim, Severiano Medina, 56, was wounded in the arm. The two were rescued by the Fire Department and Samu (Mobile Emergency Care Service) and taken to Santa Casa.
Days later, Wellington reported himself to the police and confessed to the double attempted murder. He said the photo of a kiss by his ex-wife, with whom he lived for 3 years and had a child, with Douglas, was the trigger for a premeditated crime.
After buying a gun for R$800, he went to the funeral home, waited for his ex-wife to arrive with her boyfriend and chased the two of them shooting.
