Deputy clarifies penalty for rape was not reduced in Penal Code

Santo Domingo East – The president of the Justice Commission of the Chamber of Deputies, Alexis Isaac Jiménez, clarified that it is not true that the draft law of the Penal Code of the Dominican Republic reduced the penalty for rape.

The also vice president of the Bicameral Commission of Justice said that there has been bad information in this regard, for which he listed in full the articles on rape approved by the legislators.

It stated that if the sexual assault is committed against a child or adolescent by an adult, it will be punished with ten to twenty years in prison.

Article 132.- Sexual assault. Sexual assault constitutes any lewd or lewd attack committed against a person with violence, constraint, threat, surprise, deception or by any other means that invalidates or nullifies his will.

Paragraph I.- Sexual assaults other than rape and incest will be punished with four to ten years in prison and a fine of four to ten minimum wages in the public sector.

Paragraph II.- If the sexual assault is committed against a child or adolescent by an adult, it will be sanctioned with ten to twenty years in prison.

Paragraph III.- It will be presumed that the minor is not capable of consent and, therefore, that any sexual assault perpetrated against them is violent, regardless of the way it is carried out.

Of rape and incest

Article 133.- Sexual rape. Any act of sexual penetration perpetrated by one person against another through the vagina, anus or mouth, or if any other analogous act is carried out with the introduction of an object or part of the body through one of the first two ways, constitutes rape. without consent; through violence, constraint, threat, surprise, deception or by any other means that invalidates or nullifies the will of the victim or that does not allow the same to express their consent. Rape will be punished with ten to twenty years in prison and a fine of ten to twenty minimum wages in the public sector.

Article 134.- Non-consensual sexual activity. Whoever in a relationship engages in non-consensual sexual activity will be punished with the penalties established for rape in the following cases:

1) If you have used deception, force, violence, intimidation, threat or coercion.

2) If the victim is unable to understand the nature of the act at the time it is carried out due to an illness or mental disability, whether temporary or permanent.
