Doctor’s arrest for racial injury did not follow criteria, says judge

The judge who released the investigated doctor for calling a security guard a “monkey”, in Vitória da Conquista, in southwest Bahia, justified the release by saying that the arrest of the suspect did not meet all the necessary criteria. The information was disclosed this Monday (6) by TV Sudoeste, an affiliate of TV Bahia in the region.

The case took place on Saturday (4) and the doctor was released the next day, even before going through a custody hearing, which was supposed to take place this Monday. Despite the pronouncement, Judge Dalia Zaro Queiroz did not detail what would be the criteria that were not met in prison. The case remains under investigation.

The case took place in a bar in the municipality, after the woman was prevented by the security guard from parking the car in the establishment’s parking lot, which was already full. According to information from the Civil Police, the suspect also called the victim a “black bastard”.

Witnesses said that the suspect, a native of Minas Gerais, pointed her finger at the employee’s face and said that she would enter the place whenever she wanted.

The Military Police were called and the woman was taken to the 1st Territorial Police Station – Integrated District of Public Security (Disep), where she was booked and later sent to the Nilton Gonçalves Prison, where she would undergo a custody hearing this Monday. .

In January of this year, the crime of racial injury (offense based on race, color, ethnicity, religion or origin) was equated with that of racism. With that, the crime became non-bailable, without prescription, in addition to having a penalty of imprisonment and a fine.
