Bavaria: doctor sentenced for false mask certificates

A doctor from Upper Bavaria has been sentenced to two years in prison for issuing hundreds of false mask certificates. Due to the lack of guilt on the part of the accused, the sentence was not suspended, explained District Court Director Christine Schäfer on Friday. Both the public prosecutor and the defense have now appealed the verdict. The process had already taken place on Wednesday, and several media had reported on it.
During the pandemic, corona deniers in particular had often tried to get exemptions from the mask requirement from doctors. This was then justified by the fact that the holders of the certificates could not wear masks for medical reasons. The accused doctor is said to have issued such health certificates without properly examining those affected. There were 309 cases in total.
A search had also been carried out on the accused. Nevertheless, she is said to have continued to issue false certificates afterwards. The district court also ordered a three-year professional ban against the woman. In addition, a provisional professional ban was imposed, which is to apply until the judgment becomes final.
In the past two years, the public prosecutor’s office had initiated criminal proceedings against some doctors because of such certificates. In May, a doctor was sentenced to a suspended sentence of one year and eight months in Passau.
