Judge links to the process 13 alleged hitmen detained along with Ovidio Guzmán López

Mexico City, February 11 (However).- Octavio Alarcón Terrón, Control Judge of the Federal Criminal Justice Center of Morelia, Michoacan, linked to process for two criminal cases and imposed preventive prison ex officio to a total of 13 alleged members of the Sinaloa Cartelafter being captured along with Ovid Guzman Lopezalias “The mouse”, son of the boss Joaquin Guzman LoeraEl Chapo”, as well as the alleged leader of “the minors”, on January 5, 2023, in the town of Jesús María, in culiacan.

According to a report from the Federal Judiciary (PJF), all the alleged hitmen will remain hospitalized at the Federal Center for Social Readaptation (Cefereso) number 17, located in Buenavista, Tomatlán, Michoacán, while their process is carried out.

In the first judicial case, the Judge linked to the process -for the crimes of carrying firearms, possession of cartridges and possession of chargers, all for the exclusive use of the Army-, a total of seven individuals identified as Rafael Guadalupe “E ”, Jaciel Iván “L”, Edgar Eduardo “R”, Rafael Arturo “O”, Juan Antonio “R”, Rodolfo Guadalupe “D” and Jesús Esteban “V”.

In another hearing, Alarcón Terrón initiated the process against Miguel Alejandro “D”, José Ángel “S”, Rafael “R”, Jaime “S”, Abraham “M” and Carlos Jeovanny “C”, for the same crimes as the first group and also for crimes against health, in the modality of possession of marijuana, for commercial purposes in its sale variant.

In a repetitive action, “El Ratón” filed, on February 8, 2023, a new amparo lawsuit against any possible arrest warrant and extradition to the United States. The brief requesting guarantees was filed in the Third District Court for Amparo Matters and Federal Lawsuits in the State of Mexico, under trial number 156/2023.

The acts claimed from the Ministry of Foreign Affairs (SRE) and the Attorney General of the Republic (FGR), among other authorities, are: the arrest and/or detention warrant and its execution, as well as the arrest warrant for the purpose of extradition against him.

Guzmán López also pointed out, as the responsible authority, the head of the Specialized District Court in the Accusatory Criminal System of the Federal Criminal Justice Center in Mexico City, based in the North Male Preventive Prison, acting as control judge.

In the case of the act consisting of the arrest warrant for the purpose of extradition against him, the judge granted the suspension flatly and ex officio so that the petitioner of the amparo was not extradited to the US. However, the Judge required the plaintiff to clarify his demand within five days in terms of specifying “whether the detention for extradition purposes that he claims derives or not from the extradition procedure.”

The judge also asked “El Ratón” to specifically indicate the authorities involved in the proceeding, since the Specialized District Court in the Accusatory Criminal System of the Federal Criminal Justice Center in Mexico City, was not sure whether which they did in the act claimed.

The foregoing, as the Judge pointed out, was due to the fact that “the precision of the act claimed is an essential requirement that must be contained in any amparo claim, since through this the legality or not of what is claimed is judged in the terms in which it is formulated and accredited before the person in charge”.

The son “El Chapo” should be notified at the Federal Center for Social Readaptation (Cefereso) Number 1, “El Altiplano”, located in Villa de Almoloya de Juárez, State of Mexico, in addition to ratifying the lawsuit filed in his favor , as well as make the clarifications that were required.
