Bearing in mind that the elder’s son did not want to answer for him, article 17A of the Colombian Congress stipulates that the protection centers and care institutions must receive the elderly affected to guarantee their rights.

So, in this case the Secretariat of Social Integration intervened to provide the necessary services and those that are required. The 85-year-old man will be cared for by a 24-hour protection service.

On the other hand, the son of the older adult could be brought to trial. Article 229 of the Colombian Congress, which deals with domestic violence, stipulates that if any member of the family nucleus is mistreated, either physically or psychologically, “provided that the conduct does not constitute a crime punishable by a higher penalty, he will incur in four (4) to eight (8) years in prison.
