The prosecutor before the Chamber of Cassation mario villar demanded to annul the dismissal of Cristina Kircner and of his children Máximo and Florencia in the Hotesur and Los Sauces case and requested that an oral and public trial be held, which also includes the businessmen Lazarus Baez Y Christopher Lopez. The vice president, her children and the businessmen had been investigated for alleged money laundering.

Villar presented his arguments before the judges of Chamber I of the Cassation Chamber, who must decide in this case. These are the judges Diego Barroetaveña, Daniel Petrone and Ana María Figueroa.

On the verge of the expiration of the term to present their arguments, the defenses also presented their “brief notes” and now the judges are in a position to decide whether to revoke or annul the dismissal and order that the oral trial be held or if they confirm the previous ruling. Except that a lawyer asks for a hearing, which should previously be an oral hearing before ruling.

On November 26 of last year, the vice president, her children, Max and Florence, and the rest of the defendants in Hotesur and Los Sauces were dismissed by Federal Oral Court No. 5. The decision was made by the judges Adrian Grunberg Y Daniel Forced and with the dissenting vote of the judge adriana patliotti which ruled for rejecting the proposal and for advancing towards the oral trial.

It is the third file in which Cristina Kirchner was dismissed last year without going to trial. The other two are cases of future dollar and the cause for signing the memorandum with iran.

The prosecutor of the Diego Velasco case appealed the dismissal and now the prosecutor before the Cassation Mario Villar sustained and expanded the appeal with his arguments in 105 pages, now in the hands of the judges.

Villar argued the challenged resolution for erroneous application of criminal law, criminal procedure and arbitrariness of sentence” and “disqualify the ruling as a valid jurisdictional act” and declare “its nullity.” He also asked “to order the continuation of the present process towards the stage of oral and public debate.”

And as a climax, he demanded “remove from the case the judges who made up the majority of the Federal Oral Court No. 5 in the contested resolution”, that is, Grumberg and Obligado.
