The Supreme Courtthrough associate judges, dismissed this Thursday the extraordinary appeal presented by the former head of the Federal Intelligence Agency (AFI) during the macrismo, Gustavo Arribasand its second in the hierarchy, Silvia Majdalaniin the case investigated by the espionage to the Patria Institute.

The judges Javier Leal de Ibarra, Juan Carlos Bozón, Guillermo Antelo, Ramón González and Mario Leal They also decided that the files derived from the episode continue to be processed in the Comodoro Py 2002 courts of the Federal Capital and not return to the Lomas de Zamora court, as requested by Fernández de Kirchner’s representatives.

The deputy judges, holders of federal chambers drawn for that function, had to rule on twelve appeals presented before the excuse of the current members of the highest court,

Horacio Rosatti, Juan Carlos Maqueda and Ricardo Lorenzettiwho based their departure on issues of “delicacy” and “decorum” that were not made explicit, while Carlos Rosenkrantz excused himself because he could be himself involved in an illegal espionage situation.

In addition to the case of the former president, Arribas and Majdalani were involved in a case for espionage on fifty political leaders, journalists, trade unionists and justice officialsa.

In the first instance, both were prosecuted, but the Buenos Aires Federal Chamber, when it reviewed the accusations ordered by the federal judge of Lomas de Zamora, Federico Villena, decided that there was no “illicit association” commanded by the leadership, but rather a kind of “personal initiative” of the spies involved and dictated the lack of merit of the director of the AFI and his second.

Both the espionage investigation at the Patria Institute and the tasks of monitoring and listening to references from various areas passed to Comodoro Py under the control of the judge Marcelo Martinez de Giorgi.

The Court, with the signature of its four members, convened the drawing of associate judges in the proposals of illegal espionage in February of this year, at the request of Fernández de Kirchner’s defender, Carlos Beraldiso that the pending presentations could be resolved.

“Since all the Ministers of this Supreme Court of Justice of the Nation have excused themselves within the framework of the complaint resources deduced in the proceedings by me -one of them presented already more than eight months ago-, I respectfully request that, with the urgency that the case deserves, it is defined who will be the magistrates who will resolve said direct presentations,” said Beraldi.

“What other evidence will Argentine society need, beyond the logical and legitimate adhesions, to understand that the political espionage and judicial persecution suffered by those of us who were opponents of that government, is not a partisan story,” the vice president wrote in her account of the social network Twitter at the end of 2021.

On that occasion, he also ironically commented on the lack of merit that chambermaids Mariano Llorens and Pablo Bertuzzi dictated to Arribas and Majdalani and compared it to typical Christmas gifts.
