A court in the Vologda region fined 36-year-old Dmitry B. for not paying at the restaurant. Drinking, eating, and trying to bow politely without retribution is an administrative offense. Unless, of course, the person has chosen not the most expensive restaurant.
According to the united press service of the courts of the Vologda Oblast, on the evening of September 18 this year, a Vologda resident ordered two cups of double espresso, Riskal 1860 wine, assorted cheeses for a total of 3,490 rubles at a restaurant on Vorovskogo Street in Vologda and did not pay for the order.
Judging by the order, the citizen was having something like a romantic dinner. Unless, of course, he is a fan of drinking wine with two cups of coffee at once.
Be that as it may, the citizen did not have the money to pay for such an intelligent meal, smoothly flowing into romance. When the police arrived, he explained that his bank cards were blocked.
History is silent as to whether Dmitry B.’s love boat crashed that evening about lack of money. Or the lady of the heart understood everything and forgave, as real ladies of the heart know how to forgive. However, the police did not abandon the case anyway. So the continuation of the banquet was already in the department.
Of course, many of us intuitively guess that it is illegal to eat in a restaurant and not pay. But what exactly threatens such a person from a legal point of view, not everyone knows.
In some high-profile establishments, sometimes in such situations, they resort to illegal methods. That is, they are trying to knock money out of a person. Literally. But this is not just illegal, but disgusting. If a non-paying client leaves the institution with broken (for edification) ribs and a broken nose, then one of the employees of the hot spot is simply obliged to sit in the dock. No options.
Dine in a restaurant and not pay – not formally considered a theft or fraud
In this case, fortunately, the restaurateurs allowed their client to learn the legal facets of the situation.
“The magistrate of the Vologda region on judicial plot No. 4 in the city of Vologda brought 36-year-old Dmitry Borisov to administrative responsibility under Article 7.27.1 of the Code of Administrative Offenses of the Russian Federation (causing property damage to the owner or other owner of property by deception or abuse of trust in the absence of signs of a criminally punishable acts), – said in the united press service of the courts of the Vologda region. – The magistrate sentenced Borisov in the form of an administrative fine in the amount of 5,000 rubles. The injured party has the right to file a claim for damages in civil procedure.
In other words, a fine is a fine, but you will most likely have to pay for dinner. But now the 36-year-old citizen has learned an important legal nuance: eating well in a restaurant without money is not equivalent to theft or fraud. Otherwise the matter would have been much more serious. If the court considered that eating cheese without payment would be like stealing it, a man would be under a criminal offense. After all, the minimum threshold for damage in this case is 2.5 thousand rubles.
However, according to the established practice, overeating a restaurateur is “just“ causing damage to property. ”The minimum threshold for a criminal article is 250 thousand rubles. Thus, it is not a free dinner that is criminal, but quite a decent banquet at the expense of the institution.
