The federal prosecutor Federico Delgado asked to declare the incompetence of the Buenos Aires federal jurisdiction to investigate the complaint for the possible existence of an illicit association between police officers and government officials of the city of Buenos Aires, presented by two legislators after the crime of Lucas González, the adolescent 17-year-old assassinated by members of the City Police in Barracas.
In an opinion delivered to federal judge Sebastián Ramos, the prosecutor Delgado requested that the complaint presented in the courts of Comodoro Py by the Buenos Aires legislators of the Frente de Todos (FdT) Leandro Santoro and Victoria Montenegro be referred to the ordinary justice of the City, reported judicial sources
“The material support of the complaint justifies the work of judicial review, in accordance with article 188 of the CPPN. However, it must be filed in the relevant courts,” Delgado explained in the opinion, on the complaint based on a journalistic investigation published by the Clarín newspaper.
In the case, “there are two reasons why the investigation should remain in the hands of the local judicial authorities. The first has to do with the place, because the place of commission is the autonomous city,” he explained.
Regarding the second, it specified that “these are events that do not justify the exhaustive possibilities of intervention that article 33 of the code of forms assigns to the federal justice”
“The complaint narrates common crimes, committed by local officials, in an autonomous territory that has its authorities instituted. Therefore, VS must correct the point and send the complaint to the pertinent office of the ordinary justice of the city so that they can be determined. the magistrates who must know the facts, “he concluded.
Judge Ramos will have to decide now if he declares himself incompetent and refers the complaint to the Buenos Aires jurisdiction.
